1. Introduction
Welcome to Sazzy Cards ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website sazzycards.com (the "Site"), the Sazzy Cards Sync application (the "App"), and the purchase of our products. By accessing our Site, using the App, or placing an order, you agree to be bound by these Terms.
2. Products
Sazzy Cards sells greeting cards printed on premium Hemp Heritage paper. Our products are intended for adults aged 18 and over and contain humorous content that may include mature themes, language, and cannabis references. All product images on our Site are for illustration purposes. Colors and finishes may vary slightly due to screen calibration and printing processes.
3. Orders and Pricing
- All prices are listed in Canadian Dollars (CAD) unless otherwise stated.
- Prices include the cost of the greeting cards and envelopes but exclude taxes and shipping, which are calculated at checkout.
- Prices are subject to change without prior notice. The price at the time of your order is the price you pay.
- We reserve the right to limit order quantities.
- An order is confirmed only when you receive an order confirmation email from us.
- We reserve the right to cancel any order for any reason, including product unavailability, pricing errors, or suspected fraudulent activity. If we cancel your order, you will receive a full refund.
4. Payment
We accept payment via credit card and other methods displayed at checkout. Payment is collected at the time of order. All transactions are processed through PCI DSS Level 1 compliant payment providers. We do not store your full credit card number, CVV, or sensitive payment data on our servers.
By submitting payment, you confirm that you are authorized to use the payment method provided.
5. Shipping
- Orders are shipped from Canada via Purolator, UPS, FedEx, or other carriers as available.
- Shipping rates are calculated at checkout based on destination address, package weight (approximately 1 lb per bundle), and dimensions.
- Estimated delivery times are provided at checkout but are not guaranteed. Actual delivery depends on carrier performance and destination.
- We are not responsible for delays caused by carriers, customs processing, weather events, or other circumstances beyond our control.
- Risk of loss and title transfer to you upon delivery of the package to the shipping carrier.
- For international orders: you are responsible for any customs duties, import taxes, or fees imposed by your country.
6. Taxes
Applicable Canadian taxes (GST, HST, PST, QST) are calculated and displayed at checkout based on your shipping destination:
- Canadian customers: Charged the applicable federal and provincial sales taxes based on shipping province.
- International customers: Not charged Canadian sales tax. You may be subject to customs duties and import taxes in your destination country, which are your responsibility.
7. Returns and Refunds
Due to the personalized nature of our products (custom-selected greeting card bundles), we offer refunds or replacements only in the following circumstances:
- Products received in a damaged or defective condition
- Incorrect items shipped (cards different from what was ordered)
- Order not received within the estimated delivery window plus 10 additional business days
To request a refund or replacement:
- Contact us at hello@sazzycards.com within 14 days of receiving your order
- Include your order number and a description of the issue
- For damaged items, include photographs showing the damage
We do not accept returns for change of mind. Approved refunds are processed to the original payment method within 5-10 business days. Refunds are also reflected in our accounting system as credit memos.
8. Intellectual Property
All content on our Site — including card designs, artwork, illustrations, text, logos, brand names, graphics, photographs, and website code — is the property of Sazzy Cards or our licensed contributors and is protected by Canadian and international copyright, trademark, and intellectual property laws.
You may not reproduce, distribute, modify, publicly display, create derivative works from, or commercially exploit any content from our Site without our prior written consent.
The Sazzy Cards name, logo, and "Rude, Crude & Hilarious" tagline are trademarks of Sazzy Cards.
9. Guest Checkout
Our Site uses guest checkout — you do not need to create an account to place an order. Your billing and shipping information is collected at checkout solely to process and deliver your order. If you contact us regarding an order, please have your order number and email address available for verification.
10. Sazzy Cards Sync Application
Our Site uses the Sazzy Cards Sync application to synchronize order, invoice, payment, and inventory data with our accounting platform. By placing an order on our Site, you acknowledge and agree that:
- Your order information (name, address, email, order details, and payment status) will be transmitted to our accounting platform for invoicing and record-keeping purposes
- This data is transmitted securely via encrypted API connections using OAuth 2.0 authentication
- The accounting platform may store your data in accordance with its own terms and privacy policy
- Inventory quantities are synchronized between our Site and accounting platform, which may affect product availability in real-time
- In the event of a refund, a credit memo will be created in the accounting platform
The Sazzy Cards Sync application does not collect any data beyond what is necessary for order processing, invoicing, payment recording, and inventory management.
11. Prohibited Uses
You agree not to:
- Use our Site for any unlawful purpose or in violation of any applicable law
- Attempt to gain unauthorized access to our systems, servers, or databases
- Interfere with or disrupt the proper functioning of our Site
- Submit false, misleading, or fraudulent information
- Resell our products commercially without written authorization
- Use automated tools, bots, or scrapers to collect data from our Site
- Circumvent any security measures or access controls
- Impersonate another person or entity
12. Limitation of Liability
To the maximum extent permitted by applicable law:
- Sazzy Cards shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Site, the App, or the purchase of our products.
- Our total aggregate liability for any claim arising from these Terms, the Site, or any order shall not exceed the total amount you paid for the specific order giving rise to the claim.
- We are not liable for any loss, corruption, or unauthorized access to data transmitted to or from third-party services, including our accounting platform.
- We provide our Site and services on an "as is" and "as available" basis without warranties of any kind, express or implied.
13. Indemnification
You agree to indemnify, defend, and hold harmless Sazzy Cards, its owners, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your violation of these Terms, your use of our Site, or your violation of any law or third-party rights.
14. Third-Party Services
Our Site uses third-party services for payment processing, shipping, email delivery, and accounting. Your interaction with these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices, availability, or performance of third-party services.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of the Province of Alberta, Canada.
16. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sazzy Cards regarding your use of our Site and supersede any prior agreements or understandings.
18. Changes to These Terms
We reserve the right to update these Terms at any time. Material changes will be posted on this page with an updated "Last Updated" date. Your continued use of our Site after such changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
